Bespoke Journey: Release of Liability & Responsibility Agreement
We are honored to be curating your upcoming journey with Ember & Co. (a division of LuxNomad Travels, LLC). While every detail has been thoughtfully arranged, travel is, by nature, an exploration of the unpredictable. Before we finalize your arrangements, please review and acknowledge the following:
1. Assumption of Risk
I acknowledge that travel involves certain inherent risks, including but not limited to physical activities, changing environmental factors, wildlife encounters (where applicable), and health-related challenges. I understand that infrastructure and medical access in international destinations may differ from my home country. I voluntarily accept all personal risks associated with this experience.
2. Health & Medical Considerations
I confirm that I am in good physical and mental health and able to participate in the activities outlined in my bespoke itinerary. I have consulted with a healthcare professional if necessary and will travel with any required medications or medical equipment. I agree to notify Ember & Co. of any mobility or medical changes prior to departure.
3. Travel Insurance
I understand that comprehensive travel insurance is a condition of my journey. I have been strongly advised to secure coverage for medical emergencies, emergency evacuation, trip cancellation, and lost items. I acknowledge that Ember & Co. is not responsible for costs related to uncovered incidents or my choice to decline specific coverage (such as Cancel For Any Reason).
4. Release of Liability
In consideration of Ember & Co. making arrangements for my travel, I hereby release, discharge, and hold harmless LuxNomad Travels, LLC (DBA Ember & Co.), its employees, and partners from any and all liability, claims, demands, or causes of action—now known or unknown—arising out of any accidents, injuries, disruptions, medical issues, or service delays beyond their direct control.
5. Independent Vendors & Third Parties
I understand that Ember & Co. collaborates with trusted third-party providers—including hotels, transport companies, and local guides—to deliver this experience. I acknowledge that these are independent contractors and Ember & Co. is not liable for the specific actions, omissions, or service quality of these independent vendors.
6. Responsibility & Conduct
As a guest, I agree to:
- Review all itinerary details and updates provided in the final travel app.
- Arrive on time for scheduled transfers and private activities.
- Conduct myself with maturity, respect, and mindfulness toward local communities and partners.
- Respect all local laws, customs, and safety regulations of the destination.
- Take personal responsibility for my belongings and overall conduct.
Disruptive, unsafe, or disrespectful conduct may result in removal from activities or accommodations without refund.
